Zimbabwe is currently facing a critical constitutional and democratic challenge through the proposed Constitutional Amendment Bill No. 3 (CAB3). Many citizens, civil society organisations, constitutional lawyers, and democracy advocates argue that the Bill threatens the principles upon which the 2013 Constitution was founded. The 2013 Constitution was adopted through a national referendum and represents the will of the Zimbabwean people. Any attempt to alter fundamental constitutional principles for the benefit of current office holders undermines the rule of law and (our) constitutional democracy.
Presidential Term Extension
One of the most controversial aspects of CAB3 is the proposal that could allow President Emmerson Mnangagwa to remain in office until 2030 instead of leaving office in 2028 as provided for under the current constitutional organisations continue to raise A strong democracy requires citizens to be able to express opposing views without intimidation or fear,but people are being misinformed, persecuted and tortured,
Many Zimbabweans believe that citizens should retain the direct right to choose their President through free and fair elections.
Democratic governance depends on effective checks and balances between the Executive, Parliament, and the Judiciary. Critics of CAB3 argue that some proposed changes could weaken independent institutions and increase executive influence over state structures. Constitutional changes should be driven by genuine public consultation and broad national consensus (ie Referendum), Many civic groups have called for greater transparency and meaningful citizen involvement in any constitutional reform process. Many Zimbabweans argue that national attention should focus on addressing economic challenges, employment creation, healthcare, education, and service delivery rather than extending political terms of office
Role of Civil Society
Organisations such as the Zimbabwe Human Rights Organisation (ZHRO) and the Constitution Defenders Forum (CDF), (which I am a member of), just to mention a few, are advocating for constitutionalism, democratic accountability, respect for human rights, and adherence to the principles contained in the 2013. CAB3 proposes extending presidential terms from five to seven years and could allow President Mnangagwa to remain in office until 2030, while opponents argue that such changes weaken democratic accountability and should require broader public approval.
